These Terms of Service govern your use of newrubbertrack.com and purchases from TrackTECH Equipment Solutions LLC (“TrackTECH,” “we,” “us,” or “our”).

If you place an order on behalf of a company or other organization, you represent that you are authorized to act for that organization.

Product and Fitment Information

TrackTECH provides product descriptions, specifications, photographs, compatibility information, and fitment assistance for general purchasing guidance.

Heavy-equipment parts can vary by machine model, serial-number range, configuration, and prior modification. Customers are responsible for providing complete and accurate machine, serial-number, part-number, and track-size information.

When fitment is uncertain, contact TrackTECH before ordering. Do not install or operate a product if it appears incorrect.

Product images may be representative. Minor differences in appearance, markings, tread details, packaging, or manufacturing may occur without affecting the product’s intended application.

Orders and Acceptance

Submitting an order and receiving an automated confirmation does not constitute final acceptance or guarantee fulfillment.

TrackTECH may verify payment, shipping, fitment, pricing, inventory, or other information before accepting an order.

We reserve the right to limit quantities or reject, correct, or cancel an order because of:

• Inventory or availability changes

• Pricing, description, or data errors

• Suspected fraud or unauthorized activity

• Shipping or delivery restrictions

• Incomplete or unverifiable information

• Other reasonable business or legal requirements

If TrackTECH cancels an order after payment, the applicable amount will be refunded to the original payment method.

Pricing and Payment

Prices, promotions, availability, and product information may change without notice.

We make reasonable efforts to keep information accurate but may correct errors at any time. TrackTECH is not required to honor an incorrect price resulting from a typographical, technical, supplier, or data error.

Customers authorize TrackTECH and its payment providers to charge the selected payment method for the order, taxes, shipping, and other disclosed charges.

Taxes

Applicable sales, use, or other taxes may be collected as required by law.

Tax-exempt customers are responsible for providing valid exemption documentation. Tax adjustments cannot always be completed after an order has entered fulfillment.

Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy.

Processing and delivery dates are estimates unless TrackTECH expressly agrees otherwise in writing. TrackTECH is not responsible for carrier delays or circumstances outside our reasonable control.

Customers are responsible for accurate delivery information and applicable carrier charges caused by reconsignment, redelivery, storage, limited access, liftgate requirements, missed appointments, or inaccurate information.

Cancellations, Returns, and Refunds

Cancellations are governed by our Cancellation Policy.

Returns and refunds are governed by our Return & Refund Policy. Customers must obtain authorization before returning any item.

Product Inspection

Customers should inspect products promptly after delivery and before installation.

Contact TrackTECH immediately if a shipment is damaged, incomplete, defective, or appears inconsistent with the order. Installing, operating, modifying, or improperly storing a product may affect return or warranty eligibility.

Warranties

Products may be covered by a TrackTECH, manufacturer, or supplier warranty. Warranty terms vary by product and may be provided separately.

Unless expressly stated otherwise, warranty remedies are limited to the repair, replacement, or credit authorized under the applicable warranty.

To the fullest extent permitted by law, warranty coverage does not include labor, installation, removal, equipment rental, towing, travel, lost production, lost revenue, downtime, or other incidental or consequential expenses.

Damage caused by improper fitment, installation, maintenance, use, storage, accidents, abuse, modifications, or normal wear is not considered a manufacturing defect.

Website Use

You may use this website only for lawful personal or business purchasing purposes.

You may not:

• Introduce malicious software or harmful code

We do not guarantee that the website will always be uninterrupted, error-free, current, or free from harmful components. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Where liability cannot legally be excluded, TrackTECH’s aggregate liability relating to a product or order will not exceed the amount paid for that product or order.

Indemnification
